A mass protest halt­ed con­trac­tors who had start­ed to build a 200 metre-long trans­port depot on a pub­lic green.

The com­pound, near Simon­sway in Wythen­shawe, is being built to con­tain mate­ri­als while Trans­port for Greater Man­ches­ter (TfGM) con­struct the Metrolink line to Man­ches­ter Air­port.
It will also con­tain machin­ery, a work­ers can­teen and be flood­lit at night.

But furi­ous res­i­dents refused to allow work­ers to put up the build­ing on Brown­ley Road claim­ing they were not con­sult­ed and do not want it on their doorstep.

And their protest stopped the work, and res­i­dents said they will chain them­selves to trees and fenc­ing if the work­ers return on Mon­day and attempt to con­tin­ue.

Alan Birchenall, 63, said: “The chil­dren use this area all the time – espe­cial­ly after school.

“It’s safe because it’s not near the road. The signs say the Metrolink won’t be fin­ished till 2016 so it could be here for four or five years.

“We saw this fenc­ing going up so we called a res­i­dents meet­ing on Thurs­day night and there was about 200 peo­ple there.

“They were all very angry. There are plen­ty of oth­er sites near­by where they could have this.”

Around 100 pro­test­ers sur­round­ed the builders on Fri­day and blocked their truck until they agreed to leave.

He said: “It just shows that when you are organ­ised you can change things.

Res­i­dents who brought traf­fic to a stand­still with a rush-hour protest are cel­e­brat­ing after plans to intro­duce a raised tram track were scrapped.

In a protest they walked across a pedes­tri­an cross­ing for more than an hour, block­ing the road. They were furi­ous at Metrolink boss­es, accus­ing them of try­ing to force through the plans which they claimed would cause traf­fic chaos and lengthy delays. But the pro­pos­als have now been dropped

From the move­ment of dis­obe­di­ence to the HSL of Euskal Her­ria  Mugi­tu! we call all the groups and peo­ple defend­ing the civ­il dis­obe­di­ence as a way of strug­gle to express your sol­i­dar­i­ty and sup­port of the three oppo­nents to the HSL pros­e­cut­ed in the Span­ish Spe­cial Court “Audi­en­cia Nacional” as a result of the action of pie throw­ing against the HSL car­ried out on the Navar­rese pres­i­dent Yolan­da Barci­na last 27 of Octo­ber in Toulouse. The action of pieing, which in any place of the west­ern world is mere­ly a humor­ous action of protest that has very few legal con­se­quences, is in our case, how­ev­er,  object of a polit­i­cal and media crim­i­nal­iza­tion that bor­ders on ridicule: so much so that the three authors of the protest may be sen­tenced to jail sen­tences as they have been pros­e­cut­ed under the accu­sa­tion of “attack” against the author­i­ty in the Spe­cial Court “Audi­en­cia Nacional” of Madrid, the excep­tion­al court which most­ly deals with crimes described as “ter­ror­ism” and before which they will have to make a state­ment on 16 of Novem­ber.

 

For this rea­son, we want to call you all to express your sol­i­dar­i­ty with the defen­dants pub­lish­ing a press release, a brief note in the media or a let­ter of sup­port in terms of denun­ci­a­tion of the manip­u­la­tion and polit­i­cal crim­i­nal­i­sa­tion, rejec­tion of the HSL and sup­port to dis­obe­di­ence; that is to say, denounc­ing the clear manip­u­la­tive and crim­i­nal­is­ing spir­it of the process dri­ven by the Gov­ern­ment of Navarre and defend­ing civ­il dis­obe­di­ence as a way of fight­ing the impo­si­tion of great infra­struc­tures that bring about seri­ous eco­log­i­cal, eco­nom­ic and social impacts, as it is the case of the HSL in our coun­try.

 

The call is framed with­in the ini­tia­tives of sup­port and sol­i­dar­i­ty with the defen­dants which have been decid­ed in an assem­bly of last Sun­day 6 of Novem­ber in Pam­plona under the mot­to “I would do also it!  HSL STOP: Dis­obe­di­ence”.

Account of what hap­pened between the anti-HSL pieing in Toulouse and the trans­fer of the case to the Span­ish Spe­cial Court “Audi­en­cia Nacional”:

 

The move­ment Mugi­tu! of dis­obe­di­ence to the HSL –in fight against the impo­si­tion of the “Basque Y” and the “Navar­rese cor­ri­dor of High speed”–, sup­port­ed by the Occ­i­tan move­ment Lib­er­tat, made a protest action on 27 of Octo­ber inter­rupt­ing the 29th Ple­nary Coun­cil of the CTP (Com­mu­ni­ty of Work of the Pyre­nees) that was being held in the Occ­i­tan city of Toulouse and throw­ing three meringue pies in the face of the pres­i­dent of the Foral Com­mu­ni­ty of Navarre Yolan­da Barci­na, with the aim of denounc­ing the impo­si­tion of the HSL in our coun­try. Indeed, the Basque Gov­ern­ment and the Navar­rese are deter­mined to impose these dis­put­ed projects at a time when the con­struc­tion of new lines of High speed is ques­tioned in many coun­tries because of its ruinous and destruc­tive char­ac­ter. At the same time of the pieing, we demon­stra­tors explained the rea­sons of the action in the meet­ing room, showed posters and shout­ed slo­gans against the HSL as we threw leaflets demand­ing the imme­di­ate paraly­sa­tion of the “Basque Y” works and the aban­don­ment of the project of the Navar­rese cor­ri­dor of the HST, infra­struc­tures of high eco­log­i­cal, eco­nom­ic and social impact in our coun­try and char­ac­ter­ized by an absolute lack of infor­ma­tion and social debate, refus­ing the par­tic­i­pa­tion of the pop­u­la­tion in the deci­sion mak­ing. “In any case — we said–, the solu­tions must be found in a deep trans­for­ma­tion of the present soci­ety, because the cri­sis is becom­ing worse and it is evi­dent that we must not only reduce and dis­trib­ute the “pie”, but also and main­ly change its recipe”.

 

In Toulouse , the action of the pieing was made with­out any oth­er inci­dents, tak­ing place like any­where else in the world as a humor­ous action of protest that  has very few legal con­se­quences. There was no inter­ven­tion from the police or  from the agents in charge of the secu­ri­ty of the meet­ing, so nobody was arrest­ed and after the action, the activists even gave a small press con­fer­ence in the out­side of the build­ing explain­ing the rea­sons for the protest. Nev­er­the­less, in the Span­ish state, the Gov­ern­ment of Navarre imme­di­ate­ly made a pub­lic dec­la­ra­tion of “con­dem­na­tion”, con­ceived with clear aims of polit­i­cal­ly manip­u­lat­ing and crim­i­nal­is­ing the anti-HSL pie throws, final­ly sus­pend­ing the activ­i­ty of the foral par­lia­ment and boast­ing about being a vic­tim, which bor­dered on ridicule, where­as in the street the action was received with an enor­mous delight in ample sec­tors of the pop­u­la­tion.

 

In view of the infor­ma­tive poi­son­ing start­ed by the Gov­ern­ment of Navarre, those of us who took part in the action quick­ly decid­ed to call a press con­fer­ence for the fol­low­ing day in Pam­plona, with the pur­pose of giv­ing all the details about the protest and in order to deny the sup­posed “vio­lent” char­ac­ter of the pie throws, mak­ing clear that this form of action does not mean to cause phys­i­cal harm to the cho­sen per­son, but to dam­age the image of the author­i­ty that he /she rep­re­sents. But as soon as we arrived in Pam­plona in the after­noon of the 28th, the Foral Police arrest­ed the three activists of the group in the street, when they were going to the press con­fer­ence. The police said that they were accused of “Attack to the author­i­ty” and trans­ferred them to police sta­tion. When we con­tact­ed sev­er­al lawyers, these showed their sur­prise about the cir­cum­stances in which the arrests were made, as there were appar­ent­ly no judi­cial dili­gences in the coun­try where the protest had tak­en place. Con­cern­ing the arrests, it must be said that the last per­son who was set free had spent 22 hours in jail and denounced the treat­ment received since he had been pre­vent­ed from sleep­ing dur­ing the night. The arrest­ed were forced to give DNA sam­ples as an indis­pens­able con­di­tion to be released, although nei­ther is it   oblig­a­tory nor did it have any jus­ti­fi­ca­tion in this case since the action had been pub­lic and the arrest­ed peo­ple were going to give a press con­fer­ence, also pub­lic.

 

Final­ly, our com­pan­ions were set free by the Foral  Police that charged them for a crime of “attack to the author­i­ty”, in addi­tion  trans­fer­ring the case to the Span­ish Spe­cial Court “Audi­en­cia Nacional”. In oth­er words,  the Navar­rese pres­i­dent Yolan­da Barci­na, who con­sid­ered, in her first dec­la­ra­tions, the action of the anti-HSL pieing to be “a very sweet begin­ning” for her pres­i­den­cy at the front of the CTP, has not accept­ed the “sweet­ness” of our protest very well. It is so much so that with the accu­sa­tion made, these three peo­ple may be sen­tenced to jail by an excep­tion­al court, before which they have been called to make a state­ment next 16 of Novem­ber

What to expect — this years Earth First! Win­ter Moot takes place in South Lanark­shire, Scot­land. In a months time envi­ron­men­tal­ists from across the UK and beyond will con­verge to dis­cuss and debate. Below is an update from the organ­is­ing col­lec­tive who are work­ing on the pro­gram.

The Moot 2012 col­lec­tive has felt that at pre­vi­ous EF! Gath­er­ings groups have pri­mar­i­ly attend­ed to recruit for their respec­tive cam­paigns. Yet those who attend EF! Gath­er­ings are pre­dom­i­nant­ly already active, mak­ing them good places for net­work­ing, but not nec­es­sar­i­ly for out­right recruit­ment. We recog­nise the effort gath­er­ing organ­is­ers put into plan­ning agen­das but often the more dis­cur­sive aspects of the gath­er­ings focus on larg­er,  abstract ques­tions and debates have often been framed by self-appoint­ed experts. We feel that these dis­cus­sions inef­fec­tive­ly attempt to find answers or reach con­sen­sus where this is inap­pro­pri­ate.

For exam­ple at the first EF! Gath­er­ing 20 years ago the ques­tion was asked: ‘What is EF!?’ 20 years lat­er in 2011 at the last Moot the same ques­tion was still being asked …

The answer is EF! is what we make it, and this year we are going to make it a space in which we can approach our cam­paigns both crit­i­cal­ly and ana­lyt­i­cal­ly by ask­ing more spe­cif­ic and prac­ti­cal ques­tions. Our activism should be con­stant­ly evolv­ing not stuck in a rut ask­ing the same ques­tions again and again.

The agen­da will be designed to ask ques­tions around four key issues: the tac­tics we use; the strate­gies that we employ in our cam­paigns; com­mu­ni­ty sol­i­dar­i­ty; and sus­tain­able activism. There will be no attempt to reach con­clu­sions or con­sen­sus espe­cial­ly about what EF! is. Instead we want to have dis­cus­sions that lead to new ideas that could evolve ongo­ing cam­paigns or give cre­ative inspi­ra­tion to ones that are just get­ting start­ed.

A free space will be pro­vid­ed in which cam­paigns will be able to hold meet­ings and have fur­ther dis­cus­sions if they wish, and there will also be some space giv­en for cam­paign updates with an empha­sis on hon­est analy­sis rather than pro­mo­tion.

A PROTESTER who is the lat­est to sit in the branch­es of a threat­ened tree in Irton yes­ter­day demand­ed answers to four ques­tions – one of which was aimed square­ly at the Prime Min­is­ter – before she leaves her leafy home.

The 17-year-old Bridling­ton girl, who is known only as Beech Nut, had been there since Fri­day and is the fifth tree­top pro­test­er since the start of the sit-in two weeks ago today.

She said that a spe­cial appeal had also been set up. She said: “I am here to launch the Irton Tree Foun­da­tion and would like to appeal for any help with our cause.”

Beech Nut said she want­ed to dis­pel any mis­con­cep­tions that the protest had cost coun­cil tax­pay­ers £250,000 – because their protest began after the deci­sion to fell the tree had been tak­en.

She added that, while they did not roost in the tree, bats used it as a pri­ma­ry feed­ing site. She said: “I’d like to see the results of a rep­utable bat sur­vey.”

Beech Nut said that the vil­lagers had been treat­ed with dis­re­spect and deserved answers. She asked: “Has the evi­dence been seen by a high court judge?”

And in a ques­tion direct­ed at Prime Min­is­ter David Cameron she asked about the valid­i­ty of tree preser­va­tion orders – the beech tree was the sub­ject of an order but it was over­ruled by a judge. She said: “It’s not just about this tree, in this vil­lage, it’s about all trees in Eng­land.”

A North York­shire Coun­ty Coun­cil rep­re­sen­ta­tive read out a state­ment on Fri­day which said that any­one pre­vent­ing the tree felling, which is like­ly to take place by the end of this week, could face a prison sen­tence.

Tree sup­port­ers have tak­en sep­a­rate legal advice to chal­lenge the court deci­sion and are wait­ing to hear the results.

Irton res­i­dent David Park­er said that they would con­tin­ue the protest until the first “chain­saw touched the trunk”. He added: “We’ve been told that some time this week the tree will def­i­nite­ly be felled but no offi­cial per­son has come here so far.”

He said that they would con­tin­ue to look into every legal avenue that they pos­si­bly could. He said: “We are quite with­in our rights to do so. We have a right to object peace­ful­ly against some­thing we dis­agree with. We will act with­in the law.”

The tree has been the sub­ject of a long-run­ning legal bat­tle between vil­lagers, two local author­i­ties and a near­by home­own­er, who suc­cess­ful­ly applied to a judge to have the beech cut down.

An old beech tree has been occu­pied since Tues­day 20th Sep­tem­ber, to stop it’s felling, with a change-over of occu­pi­er last Sat­ur­day, whilst bor­ough and coun­ty coun­cil bat­tle it out in the courts over whether the tree should be felled or pre­served.

Back­ground

The local com­mu­ni­ty has been protest­ing against the destruc­tion of an 80+ year old Beech Tree in Irton, North York­shire for sev­er­al years.

Irton is a vil­lage which has a strong com­mu­ni­ty spir­it. Res­i­dents and out­siders have come togeth­er to show their oppo­si­tion to a North York­shire Coun­cil deci­sion which goes against com­mon sense.

One vis­i­tor to the vil­lage stat­ed “ I went pre­pared to think it was just an ordi­nary tree …. But it is excep­tion­al! It is beau­ti­ful – it adds grace to the vil­lage. Los­ing it would make a huge dif­fer­ence.”

The tree has a ‘tree preser­va­tion order’ on it, which pre­sum­ably means that tree experts feel it should not be destroyed. Despite this as well as local oppo­si­tion from res­i­dents, local coun­cil­lors, the gen­er­al pub­lic and envi­ron­men­tal experts, — North York­shire Coun­ty Coun­cil has decid­ed to fol­low legal pro­ce­dures to destroy the tree. ….

Why is the tree being destroyed?

Occu­piers of a near­by house state that the tree roots are affect­ing, or may affect in the future:

• The bound­ary walls
• The drainage sys­tem
• The cur­rent own­ers access to the prop­er­ty

Why these are not valid rea­sons

The bound­ary walls
• There is no vis­i­ble sign of dam­age to bound­ary walls.

“ It is not in any way affect­ed – it is per­fect­ly upright” says one inde­pen­dent observ­er. House own­ers need to pro­vide evi­dence that dam­age has hap­pened. This con­cern can­not be tak­en seri­ous­ly.

The drainage sys­tem
• 2 expert reviews or ‘tech­ni­cal reports’ have appar­ent­ly been con­duct­ed. Alleged­ly, the first report found that the dam­age to drains pre­ced­ed the tree, and the sec­ond report found that the drains were being dam­aged by the tree.
o Who has com­mis­sioned these reports? No infor­ma­tion has been pro­vid­ed to the pub­lic about who did these reports. Why aren’t these in the pub­lic domain?
o A local tree stu­dent has explained that any dam­age done to walls or drains can nowa­days be dealt with by localised meth­ods – the affect­ed roots can be treat­ed and there is no need to cut down an entire tree.

The cur­rent own­ers access to the prop­er­ty
• The cur­rent occu­piers can move their access point, or con­sid­er using sus­tain­able meth­ods of trans­port.
o Long term res­i­dents of the vil­lage have stat­ed that the prop­er­ty entrance was orig­i­nal­ly well away from the tree, and only in recent years has the gate­way been altered.
o Res­i­dents have indi­cat­ed that the cur­rent own­ers wrere pre­vi­ous­ly inter­est­ed in prop­er­ty devel­op­ment on the site – they sub­mit­ted a plan­ning appli­ca­tion for the devel­op­ment, of sev­er­al dwellings…… but were declined.

North York­shire Coun­ty Coun­cil may have fears about the finan­cial impli­ca­tions of deci­sions they make now, how­ev­er it is unac­cept­able to make the fear of an indi­vid­ual home own­er suing the coun­cil over­ride the rights and needs of nor­mal cit­i­zens.

The pro­test­ers

This protest is entire­ly peace­ful, and there was a feel­ing of con­fu­sion amongst pro­test­ers sur­round­ing the con­cept that what they are doing is a law­break­ing activ­i­ty.

“We felt the tree had been con­demned. We need­ed to stop it hap­pen­ing. It is dis­gust­ing.”

The protest includes a tree-sit in. 2 res­i­dents have been resid­ing in the tree in order to save it.

“We got lad­ders, and stood them up the tree. An hour lat­er, the con­trac­tors turned up. There are 60 and 70 year olds who real­ly do not want this tree cut down. Come and have a look – there is no evi­dence of dam­age.”

Pro­tes­tors in and out of the tree have been sup­port­ed by a strong com­mu­ni­ty, pro­vid­ing moral sup­port, food, drink and warmth, as well as the oblig­a­tory wee jar.

Some 500 vil­lagers staged a three-day protest fol­low­ing the death of large num­bers of fish in a local riv­er.

Some demon­stra­tors broke into the plant in Zhe­jiang province, destroy­ing offices and over­turn­ing com­pa­ny cars before being dis­persed by riot police.

RIOTS have bro­ken out in Chi­na against a fac­to­ry pol­lut­ing local water as resis­tance grows glob­al­ly to the neolib­er­al indus­tri­al night­mare.

Reports Chi­na For­bid­den News: “Vil­lagers in Hain­ing city, Zhe­jiang province in Chi­na have held three days of protest against Jinko Solar Co. dis­charg­ing heavy can­cer-caus­ing pol­lu­tion.

“Vil­lagers and jour­nal­ists were beat­en by com­pa­ny secu­ri­ty. The pro­test­ers beat local offi­cials and over­turned four police cars. The police also fired tear gas.

“Online sources state that over 10 peo­ple are injured or dead.

“A human rights activist said that Chi­nese Com­mu­nist Par­ty’ (CCP) sys­tem was caus­ing the strug­gle in peo­ple’s lives.

“We feel that it is social­ly respon­si­ble to close the fac­to­ry first and to take cor­rec­tive mea­sures,” com­pa­ny spokesman Thomas Jing told the BBC.

He said there had been acci­den­tal dis­charge into the sur­round­ing area dur­ing a rain­storm at the end of August.

He said chem­i­cals used at the fac­to­ry had been stored in an open area rather than a ware­house, and that the cov­er­ing had been ripped off dur­ing the unex­pect­ed­ly harsh weath­er.

Mr Jing said the firm was inves­ti­gat­ing whether the flu­o­ride was respon­si­ble for the death of the fish. A clean-up was also under way, he said.

“The Jinko Solar com­pa­ny is a sub­sidiary of a New York Stock Exchange-list­ed Chi­nese solar com­pa­ny, ful­ly financed by Hong Kong Pak­er Tech­nol­o­gy Co., Ltd.

“They pro­duce solar wafers, cells and oth­er prod­ucts, export­ing to more than twen­ty coun­tries with­in Europe, Asia, and the Unit­ed States.

“The plant is locat­ed in Hain­ing city, Zhe­jiang province and Shangrao city, Jiangxi province.
There are over 10,000 employ­ees and the plant cov­ers more than 165 acres.

“Vil­lagers blame the com­pa­ny for dis­charg­ing pol­lut­ed water and harm­ful gas­es into the envi­ron­ment, caus­ing the mas­sive deaths of fish float­ing in the riv­er.

“Local vil­lagers found that there were over 10 peo­ple who devel­oped can­cer as a result of the pol­lu­tion.”

This is the lat­est exam­ple of Chi­nese cit­i­zens being spurred to action over envi­ron­men­tal wor­ries. Last week, Shang­hai halt­ed pro­duc­tion at two fac­to­ries over wor­ries about lead poi­son­ing.

Last month, a chem­i­cal fac­to­ry in the north-east­ern city of Dalian was ordered to move after 12,000 res­i­dents took to the streets over pol­lu­tion fears.

This spring saw works to clearcut a huge Khim­ki for­est con­tin­ue unabat­ed. In spite of numer­ous and mas­sive peo­ple protests, all the legal and lib­er­al stuff (polls, peti­tions, law suits, con­certs, demos, vig­ils, etc.), author­i­ties, law enforce­ment, and their fas­cists and mafia lack­eys (for­ev­er togeth­er in Rus­sia) push for the com­ple­tion of clear-cuts so that they may get on to the actu­al road-build­ing. “An ELF group claims respon­si­bil­i­ty for torch­ing of a work­ers’ shed (the build­ing was checked to ensure it was unoc­cu­pied pri­or to the attack) at a tree­cut site in south­ern Moscow (Bitcevs­ki for­est) on the night of april the 11th. An 5 litres of gaso­line and incen­di­ary device for time delay were used because of close prox­im­i­ty to guard­house and seri­ous sen­try pres­ence in the region. The for­est has seen numer­ous eco­tage actions (spik­ing, torch­ings of vehi­cles and stor­age sheds, etc), hence intense police atten­tion. No pho­tos or videos were released. The shed and its con­tents explod­ed 5 min­utes lat­er for unknown rea­sons.

“Urban gueril­las” in Moscow have claimed respon­si­bil­i­ty for the torch­ing of a large exca­va­tor at a con­do­mini­um con­struc­tion site near the Bitcevs­ki for­est on April 9.
