Court rejects ASBOS for airport activists

On Fri­day, Lough­bor­ough Mag­is­trates Court reject­ed calls from the Crown Pros­e­cu­tion Ser­vice to slap ASBOs on the 24 Plane Stu­pid activists who they described as “highly organ­ised extrem­ist­sâ€? that were arrest­ed in con­nec­tion with the shut down of Not­ting­ham East Mid­lands short haul air­port in Sep­tem­ber.

On Fri­day, Lough­bor­ough Mag­is­trates Court reject­ed calls from the Crown Pros­e­cu­tion Ser­vice to slap ASBOs on the 24 Plane Stu­pid activists who they described as “highly organ­ised extrem­ist­sâ€? that were arrest­ed in con­nec­tion with the shut down of Not­ting­ham East Mid­lands short haul air­port in Sep­tem­ber.

In an appar­ent move aimed to avoid hav­ing the case heard by a jury, the charge of pub­lic nui­sance was dropped, as was the charge relat­ing to an alleged breach of the avi­a­tion and secu­ri­ty act.

Plane Stu­pid lawyer, Mike Schwarz, described the action to the court as a “classic piece of civ­il dis­obe­di­enceâ€? and remind­ed the court that “Tony Blair him­self has described cli­mate change as the great­est threat fac­ing mankind.â€?

Cam­paign­er for Plane Stu­pid, Ellen Rick­ford, said, “The same day that we learn the gov­ern­ment is push­ing ahead with its air­port expan­sion pro­pos­als, they try to use ASBOs to stamp out peace­ful protest. Well, it seems their plans for that were as doomed as the avi­a­tion industry.â€?

17 activists got one year con­di­tion­al dis­charges (the min­i­mum sen­tence avail­able) and each was charged £70 in costs. The 5 charged with crim­i­nal dam­age in addi­tion to aggra­vat­ed tres­pass were giv­en vary­ing lev­els of com­mu­ni­ty ser­vice.

One per­son was referred to Crown Court due to unre­solved legal issues and anoth­er had his case adjourned until Jan­u­ary 31st. One oth­er activist was unable to attend court due to ill­ness.

Climate chaos and aviation: giant issue — giant letter

Yes­ter­day cli­mate activists from South­west Cli­mate Action smart­ly stormed North Som­er­set Envi­ron­ment and Plan­ning Offices to protest against the planned expan­sion of Bris­tol Inter­na­tion­al Air­port.

The plan­ners were tak­en aback by the style of deliv­ery when pre­sent­ed with a giant let­ter, but as the pro­test­ers explained, cli­mate change is a giant issue.

They occu­pied the lob­by and some climbed onto the roof, claim­ing they were try­ing to escape the ris­ing sea lev­els that cli­mate change will bring. A near­by soundsys­tem played record­ed sounds of planes tak­ing off in order to bring home to the plan­ners the effects that their deci­sions could have upon peo­ple in the South­west.

In the lob­by pro­tes­tors had the full atten­tion of key peo­ple involved in mak­ing this deci­sion and togeth­er they flood­ed them with the argu­ments: moral, envi­ron­men­tal and eco­nom­i­cal, for why expan­sion must not hap­pen.

The plan­ners admit­ted to the pro­test­ers that they might have to rethink the entire approach to the nation­al pro­gram of expan­sions in the light of increas­ing news about cli­mate change. The recent­ly pub­lished Stern Report pre­dicts that cli­mate change will push the world econ­o­my into a depres­sion if we do not act now.

Coun­cil­lor John Crock­ford-Haw­ley, North Som­er­set Coun­cil Exec­u­tive Mem­ber for Strate­gic Plan­ning and Trans­port, also agreed with our state­ment that if expan­sion went ahead it would make a mock­ery of peo­ples indi­vid­ual efforts.

Stanst­ed air­port was refused plan­ning per­mis­sion for their expan­sion last week. The plan­ners said that the Stern report was a major fac­tor in their deci­sion. The gov­ern­ment plans to expand almost every air­port in the UK, tripling air traf­fic by 2030. But this would make it impos­si­ble to meet the tar­gets for emis­sions in order to avoid run­away cli­mate change.

The pro­test­ers urged peo­ple to oppose the expan­sion. Passer­by­ers thatt felt moved wrote their com­ments on post­cards which were hand­ed in at the end of the day. The dead­line for objec­tions is Dec 22nd, which is the last chance for peo­ple to have their say.

South­west Cli­mate Action are a group of indi­vid­u­als inspired by the cli­mate camp and the glob­al move­ments for cli­mate jus­tice. They have pledged that, if the expan­sion goes ahead, they will take direct action in order to stop it.

Dear Plan­ners,

We are a group of indi­vid­u­als who are very alarmed by the pro­posed mas­ter plan to expand Bris­tol Inter­na­tion­al Air­port con­sid­er­ing con­sen­sus by cli­mate sci­en­tists that we need to take action now to avert cat­a­stroph­ic effects on humans and the ecosys­tems we are part of.

We need to pre­vent glob­al tem­per­a­tures from ris­ing by more than 2 degrees above pre-indus­tri­al lev­els: the point at which dan­ger­ous process­es caused by cli­mate change could spi­ral out of con­trol, such as the melt­ing of the West Antarc­tic and Green­land ice sheets, which could raise glob­al sea lev­els by 7m and West­on being flood­ed.

Avi­a­tion: Bris­tol Air­port already pumps out more emis­sions than the whole of Bris­tol’s traf­fic. If the air­port expan­sion go’s ahead it will be impos­si­ble for North Som­er­set to meet their tar­get of 60% cuts by 2050.

Local Econ­o­my: Tourists spend £11bn in the UK, while UK tourists spend £26 bil­lion abroad – a loss of £15bn to our econ­o­my. Region­al tourism is the sin­gle largest indus­try in the South West with 8% of all jobs; with expan­sion the tourism deficit is like­ly to dou­ble by 2030.

Fur­ther­more, the Stern report reach­es the sim­ple con­clu­sion: “the ben­e­fits of strong, ear­ly action on cli­mate change con­sid­er­ably out­weigh the costs.â€?

In light of this infor­ma­tion it is crit­i­cal that you ful­ly acknowl­edge this infor­ma­tion now.

Demand’s

Recog­nise that cli­mate change is a seri­ous glob­al threat, it demands an urgent response.

Recog­nise the glar­ing con­tra­dic­tion between the coun­cils stat­ed com­mit­ment, through the Not­ting­ham dec­la­ra­tion, to tack­le cli­mate change and the expan­sion of the air­port.

Recog­nise that if the air­port expan­sion goes ahead it will be to the detri­ment of the local and glob­al econ­o­my.

Acknowl­edge that the ‘Master Plan’ con­tains inac­cu­ra­cies and fails to deal with the issue of cli­mate change, and thus is irre­spon­si­ble.

Acknowl­edge that the peo­ple of the South West will stand by the coun­cil in the rejec­tion of this insane plan­ning appli­ca­tion. North Som­er­set coun­cil will not be alone in reject­ing the cur­rent wave of ill-con­ceived air­port expan­sions.
Uttles­ford Coun­cil Plan­ners have recent­ly turned down the expan­sion of Stanst­ed say­ing
“It would be pre­ma­ture to grant plan­ning per­mis­sion for the increased use of the run­way in advance of clar­i­fi­ca­tion by the Gov­ern­ment as to whether part of its response to the Stern Review and oth­er recent research will be to with­draw or amend its Air Trans­port White Paper.â€?
“Given new evi­dence, such as the Stern report it is uncer­tain whether the pol­i­cy of encour­ag­ing air­port growth is a rea­son­able basis on which to pro­ceed.
If the expan­sion is giv­en the go ahead, despite the acknowl­edge­ment of the above infor­ma­tion, then the coun­cil will be com­plic­it in the dev­as­ta­tion of lives, com­mu­ni­ties and habi­tats around the world, who will be hit by the impacts of cli­mate chaos.

It would be neg­li­gent for the coun­cil to allow the expan­sion, but if they do we will take sus­tained action to stop it, tak­ing respon­si­bil­i­ty for our lives and our future.

The Camp for Climate Action was just the beginning! — next meeting January 13/14th, Leeds

In August of this year hun­dreds gath­ered near Sel­by to con­front the UK’s biggest CO2 emit­ter: Drax Coal Pow­er Sta­tion. The Camp for Cli­mate Action was an inspir­ing 10 days of learn­ing, sus­tain­able liv­ing and direct action to chal­lenge the caus­es of cli­mate chaos.

There is already much enthu­si­asm for organ­is­ing anoth­er Camp, come and get involved on 13th/14th Jan­u­ary at ‘The Com­mon Place’ in Leeds (see www.thecommonplace.org.uk for direc­tions). Meet­ings will run Sat­ur­day 11am-5pm and Sun­day 10am-6pm.

This project is still at its ear­ly stages and details such as when, where and how to organ­ise the next Camp are to be decid­ed at this meet­ing. Food and crash pad accom­mo­da­tion will be pro­vid­ed. Every­one will be asked for a dona­tion of around £10 to cov­er costs. Transport minister pied for support of Heathrow expansion lobby

Alis­tair Dar­ling, Sec­re­tary of State for Trans­port, was pied today at the launch event of a pow­er­ful new indus­try coali­tion, ‘Future Heathrow’, formed to ensure expan­sion of Heathrow goes ahead. Mean­while over 100 local res­i­dents took time off work to demon­strate out­side the CBI HQ launch event, with a huge ban­ner read­ing ‘Future Heathrow Stinks’, and a new report that con­cludes that Heathrow con­tributes lit­tle to the nation­al or local econ­o­my, but sim­ply lines the pock­ets of the avi­a­tion indus­try. Future Heathrow is led by Clive Soley, once a Labour MP, now Lord Soley, now head­ing up this sleazy bunch of plan­et trash­ers with a mul­ti-mil­lion pound bud­get to over ride the res­i­dents and the plan­et. Nobody expect­ed the Sec­re­tary of State to make the phe­nom­e­nal­ly stu­pid mis­take of so pub­licly sid­ing with the avi­a­tion indus­try over such a con­tro­ver­sial project. But he did, and was repaid with car­rot cake, cream and major polit­i­cal embar­rass­ment.

In the Future of Avi­a­tion White Paper of 2003, the Gov­ern­ment paved the way for mas­sive expan­sion of the avi­a­tion indus­try despite all the evi­dence that urgent action is need­ed on cli­mate change. Trans­port is the sin­gle largest and fastest grow­ing source of CO2 emis­sions, and the sec­tor most in need of being tack­led. Yet despite this, the Gov­ern­ment is fol­low­ing a ‘pre­dict and pro­vide’ pat­tern of devel­op­ment, with more road­build­ing and avi­a­tion expan­sion. The expan­sion of Heathrow would mean more flights and CO2 emis­sions, and more noise and mis­ery for res­i­dents already suf­fer­ing under the flight paths. The num­ber of flights has rapid­ly increased to an intol­er­a­ble lev­el, with night flights and noise par­tic­u­lar­ly, mak­ing life hell. Air pol­lu­tion lev­els are already at the legal lim­it, with insane pro­pos­als to put the M4 in a tun­nel to allow the expan­sion to go ahead. Vibrant, feisty and pass­sion­ate cam­paigns have set up against the expan­sion called HACAN Clearskies,


and NOTRAG (No Third Run­way Action Group).

Many homes are threat­ened by the third run­way and sixth ter­mi­nal expan­sion, and this pro­pos­al, and oth­er plans to expand air­ports, will be fought against tooth and nail.

A cli­mate change activist pos­ing as a jour­nal­ist man­aged to gain access to the high secu­ri­ty ‘Future Heathrow’ event and, plant­ed in the front row, wait­ed her moment. She could­n’t believe the audac­i­ty of the Trans­port Min­is­ter to stick his fin­gers up at the res­i­dents groups and envi­ron­ment lob­by, and to so firm­ly side with the com­plete­ly unsus­tain­able avi­a­tion indus­try. As the first speak­er wel­comed all the suits to their exclu­sive lit­tle back slap­ping event, she sprang up and plant­ed the car­rot and cream cake firm­ly in the face of the Min­is­ter who was sat on the plat­form along­side Lord Soley, the CBI and the Cham­bers of Com­merce. As she did so, she said “Future Heathrow stinks, your bogus eco­nom­ics stink, Alis­tair Dar­ling being here stinks, and your vision for this plan­et stinks”, and was then eject­ed by secu­ri­ty guards. For­tu­nate­ly she was not arrest­ed, and after being held by the guards for a while was released. Unfor­tu­nate­ly she only had one pair of hands, oth­er­wise they would have also been doused in a pow­er­ful­ly smelly brew of com­frey and net­tle plant feed she had in her bag!

One might assume that at such a high pro­file event, espe­cial­ly with the Sec­re­tary of State attend­ing, that all the media would be there. In fact, Future Heathrow had not told the media that Dar­ling was attend­ing. They want­ed to keep it qui­et — it is a mas­sive polit­i­cal boob — and they just want­ed it as qui­et endorse­ment. They weren’t allow­ing in any jour­nal­ists that had not pre-booked — even a BBC TV crew were turned away. The lone envi­ron­men­tal activist only pulled off this metic­u­lous­ly planned feat by pre book­ing as a jour­nal­ist her­self and even so, had to nego­ti­ate triple secu­ri­ty checks and was then briefed by BA’s head of group affairs. He also kind­ly arranged a lat­er inter­view for her with Clive Soley which she sad­ly had to miss! To have arranged for an inde­pen­dent pho­tog­ra­ph­er to be admit­ted would have alert­ed their sus­pi­cians. This is why, regret­tably, there were no pic­tures. The group of most­ly elder­ly protest­ing res­i­dents out­side the event were total­ly elat­ed and tremen­dous­ly inspired by the direct action. They are now ask­ing for train­ing so that they can start their own direct action cam­paign.

The res­i­dents are furi­ous that their pre­vi­ous MP Clive Soley, has been giv­en a Labour peer­age, and now Lord Soley heads up this pow­er­ful lob­by group. All smells a bit nasty? When the ‘jour­nal­ist’, tack­led one of the heads of British Air­ways about how extra­or­di­nary it was that the Sec­re­tary of State would so obvi­ous­ly side with this new alliance, he agreed that he was sur­prised too, but added “well you know, Alis­tair and Clive are great friends”… By this act, Dar­ling has revealed his true colours, and there is no doubt that he, and new Labour don’t give a toss for the envi­ron­ment.

Even their own argu­ments — that Heathrow is vital to the econ­o­my of Lon­don, the South East and nation­al­ly — don’t add up. A report, released today by HACAN Clearskies, proves that Heathrow, as a ‘hub’, relies on tran­sit pas­sen­gers who con­tribute noth­ing to the econ­o­my, only lin­ing the pock­ets of the air­lines.

Another Director Resigns from ‘Bridge Across the Bay Co’

Prof. Bill Davies has announced his res­ig­na­tion from the noto­ri­ous ‘Bridge Across the Bay Com­pa­ny’ after protests last week at the Lan­cast­er Enivi­ron­ment Cen­tre.

Lan­cast­er Earth First! have been informed that Pro­fes­sor Bill Davies, who was one of the direc­tors for the com­pa­ny inves­ti­gat­ing the pos­si­bil­i­ty of build­ing an 11mile bridge across More­cambe Bay from Heysham to Bar­row has sent an email explain­ing that he is no longer a direc­tor of the com­pa­ny.
