Occupy Firgrove: Destruction of the trees

Save Firgrove Green Betrayed by Rushmoor26 July 2013 Wednesday morning, police, private security, fencers, tree surgeons, arrived to end the occupation of Firgrove Green and destroy the trees.

Save Firgrove Green Betrayed by Rushmoor26 July 2013 Wednesday morning, police, private security, fencers, tree surgeons, arrived to end the occupation of Firgrove Green and destroy the trees.

The planners lied, said the trees were in poor state of health. The trees had to go, as they showed the planners lied. Green space, the only green space in town, earmarked for destruction for an 80-bedroom Premier Inn hotel.

Green Frontage: The town has an abundance of green edges, including in those spaces adjacent to main roads. This characteristic is a positive asset for the town, and enhances environmental quality. — Supplementary Planning Guidance for Farnborough town centre

Last month a planning application was passed to demolish three local shops, and an Indian restaurant at Firgrove Parade in Farnborough. This would also render homeless the people living in the flats above, flats that are in very poor state of repair.

 http://keithpp.wordpress.com/2013/06/20/tragedy-for-firgrove-parade/

The planning committee were told it was not of their concern they can go somewhere else, another town maybe.

Adjacent to the site a grassy green with trees, crossed by public footpaths. Used by local people for decades. It has proven popular in the last few weeks, as people seek out the shade of the trees.

Firgrove Green is the only green space in the town centre. It is earmarked for destruction for a 80-bedroom Premier Inn hotel.

This is what in Farnborough is jokingly called town centre regeneration, destroy green space, cut down trees, destroy local businesses. George Orwell would be proud of this use of newspeak.

At the planning meeting, the committee was whipped into line by the head of planning. The committee was told the trees were in a poor state of health. And just in case they had not got the message, they were told there were no planning grounds to reject the application, and if they did, it would be lost at appeal.

Surprise, surprise, the trees are in a healthy state, nothing like they were described to the planning committee.

Two weeks ago, tree surgeons arrived to cut down the trees. Local people alerted to what was happening descended on the site. The tree surgeons managed to cut down three trees, an apple and two flowering cherries. All three healthy trees. Even the tree surgeons tasked to cut down the trees, were forced to admit, these were healthy trees.

http://keithpp.wordpress.com/2013/07/12/activists-save-trees-at-firgrove-parade/

Since then, the local community has been on high alert. They suspected the greedy developer Bride Hall would not give up. They were proven correct.

On Sunday, Knight Security started trying to remove cars under the false threat people would be fined. This could only mean one thing, Bride Hall wanted to bring in a lorry to fence the site, possibly even bring in a bulldozer or a digger to trash the site.

Before 7pm Wednesday morning, Knight Security turned up mob handed. But they were too late, local people were already on the green. A large number of police turned up, including riot police. The police were filming protesters, protesters filming the police.

The tree surgeons turned up. They drove a truck at high speed onto the site, putting protesters at serious risk of injury, and stopped very close to protesters. Fencers turned up and started to fence in the protesters. Passers by, so angry at what they saw happening, joined the protesters on the site.

A woman claiming to be an agent acting for the developer, ordered everyone off site. She refused to identify who she was. Inspector Justin Browne of Hampshire Police, then asked everyone to leave. If they refused, he would have arrested and charged for aggravated trespass. At this point, everyone decided to leave, as nothing was going to be served by being arrested. Everyone though still remained but outside the fenced off area. A group of kids outside the fenced off area, on a public right of way, were threatened with arrest. A report in the Farnborough News that protesters were evicted from the site not true.

A public right of way was unlawfully blocked. The police were asked to deal with this. They refused.

Bride Hall has not yet been issued with planning consent, and yet they have started work by clearing the site and fencing it off. In a press release, they said they would not be starting work until 2014. They told the local rag, they would not be starting for three years.

 http://keithpp.wordpress.com/2013/07/21/firgrove-parade-bride-hall-press-release/

Why start now? It can only be to destroy the evidence of healthy trees on the site.

Keith Holland, head of planning at the Rotten Borough of Rushmoor, was asked to serve enforcement action, as no planning consent had been issued to Bride Hall.

His response:

‘Having visited the site earlier today, I saw no sign of any development commencing on site. Temporary fencing had been erected to secure the site for health and safety reasons, whilst contractors removed trees from the site. The trees are on private land and are not covered by a tree preservation order. The removal of the trees does not constitute the start of development and no planning breach has occurred, as far as I could see.’

He claims not part of the work. The plans show a 80-bedroom Premier Inn hotel on the green where the trees are growing. Or is Keith Holland agreeing with the protesters, that this work was to destroy the evidence that he blatantly lied to the committee?

He also states no TPOS on the trees. And why are there no TPOs? Because the local tree officer who seems incapable of differentiating a healthy tree from an unhealthy tree, refused to serve TPOs. And who does the tree officer work for? Why none other than the head of planning. And like his boss, he is a liar. He claimed in an e‑mail, a copy of which was sent to his boss, he could not serve TPOs as planning consent had been issued. Planning consent has not been issued,

Thus we go round and round in circles.

He also contradicts the temporary borough solicitor Jeremy Rosen who wrote:

‘Your request for an emergency Tree Preservation Order is noted.  However, I have to inform you that the Council has no intention of making any such TPO.

The reason for this is that the proposed works to the trees have already been considered by the Council’s Development Control Committee as part of the wider planning application for the redevelopment of Firgove Parade.  As you know, the Committee resolved to grant consent to the proposed development, which includes the removal of the existing trees.

Therefore, having followed the proper process, the Council has already decided to permit the removal of the existing trees.  It would therefore be inappropriate and indeed preserve for the Council to now make a TPO which would effectively reverse its earlier decision regarding the trees and make it impossible to implement the planning permission.’

One says cutting down the trees nothing to do with the development. The other says TPOs cannot be served on the trees as would stop the development going ahead.

But this is what happens when you weave a web of lies, the web unravels and it is very difficult to keep your story straight.

The tree surgeons have cut all but two of the trees down.

They were expected to return in the morning, but no sign of them either yesterday or today.

Looking at the tree stumps and logs these were healthy trees that have been cut down.

One tree has been spared because it has a nesting pigeon. It is an offence under the Wildlife and Countryside Act, to disturb a nesting bird, its nest, its young or its eggs

Local people are extremely angry at what is happening. The one exception, a pathetic and rather unpleasant racist troll with an unhealthy interest in pictures of children, who if he keeps harassing people, under various fake IDs, will soon find himself served a Harassment Order. The only other, councillors and their officials who act in the interest of developers and Big Business, not the local community, local businesses.

The following night the Council met behind closed doors to discuss the Rushmoor Corruption Plan, oops sorry Rushmoor Corporate Plan, it states how much they value green space. There must be a hidden clause: Unless it is coveted by a developer, then our tree officer will condemn all healthy trees and we will rubber-stamp your planning application.

For the people of Farnborough, this was their Gezi Park moment, as in Istanbul, a green area in town, the only green area, being destroyed for development, by a corrupt council in bed with developers.

Local people are now calling for a boycott of Premier Inn and Costa, both owned by Whitbread.

Hundreds Halt Fracking Operations in Susex

In the early hours of the morning, anti-fracking activists and community members in Balcombe, Sussex, UK, successfully halted the first day of explorations for a new shale gas development by famed (infamous, rather) fracking company Cuadrilla. Over 250 people united in a powerful, peaceful, joyful blockade—that eventually convinced the trucks containing the initial fracking equipment to abandon the site.

This is community power at its best. Campaigners in Balcombe, just like those in frontline communities around the world (in the U.S., Indonesia, Argentina and elsewhere) had been calling attention to the dangers of fracking for over a year. This week, when Cuadrilla’s license for exploration and development was approved, activists quickly mobilized to organize a Great Gas Gala, inviting people in Sussex and neighboring areas to converge on Balcombe and oppose Cuadrilla’s efforts.

Yesterday’s protests are set in the context of a recent announcement by the UK government proposing a 50 percent tax cut for companies involved in shale gas extraction, the most generous tax regime for fracking in the whole world. The proposal is very much in line with the dreaded “dash for gas” that Chancellor George Osborne announced at last year’s unveiling of the budget.

It is in opposition to these efforts that groups like Frack Off, No Dash for Gas and many of our partners and allies around the country, are mobilizing public awareness and opposition, in a genuine effort to shift the power in our energy systems and put our communities and their people back in charge. The Global Power Shift UK team will be working in the upcoming months on helping build that large, inclusive movement—one that represents community interests, leverages our diversity and builds on our shared vision of a people-powered future that solves the climate crisis once and for all.

The fight in Balcombe is not over yet. Yesterday’s exploratory fracking attempt was the closest to London to date, where a lot of the finance for these operations comes from and where the tangled webs of power and influence are carefully threaded between consenting politicians and short-term profit oriented fossil fuel corporate executives. Impunity for them and their climate-wrecking efforts? No longer. Real resistance is brewing in their backyard.

Cuadrilla have temporary planning permission to drill at site in Balcombe. Permission expires in September and drilling will take at least 6 weeks so any significant delays could scupper their plans. They are exploring for tight (shale) oil, and the Kimmerage Clay shale layer they are targeting is similar to the Bakken Shale in North Dakota. Full scale production would involve thousands of wells, pipelines and compressor stations coating the Sussex countryside. This is before you get to water contamination, air pollution and accelerating climate change. See  http://frack-off.org.uk/latest-news-from-the-great-gas-gala/ for updates

P1030668Update (24/07/13): Cuadrilla Resources are bringing equipment onto the site at Balcombe now and want to start drilling by the weekend. The community is mobilisating to stop them tomorrow (Thurs) from 7am and needs help. See http://greatgasgala.org.uk/ for details.

The sleepy village of Balcombe in West Sussex, in the middle of the Weald valley, has until recently not been a place you would associate with industrial development. The surrounding countryside is among the most picturesque you will see out of the train window on the line between London and Brighton. However, in 2008 Cuadrilla Resources acquired a petroleum exploration and development licence (PEDL 244) for an area of Sussex, including Balcombe, and acquired an adjoining licence a few years later, bringing the total area of Sussex countryside they can exploit to over 270 square miles.

Summary

  • Fracking threatening Sussex countryside
  • Cuadrilla have licences for 270 square miles
  • Planning permission to drill in Balcombe
  • Targeting layer within Kimmeridge Clay
  • Analogous to Bakken Shale in North Dakota
  • Would need thousands of wells to extract oil
  • Same severe impacts as in US and Australia
  • Villagers getting organised to resist invasion
  • Cuadrilla is trying to push ahead regardless
  • Need permits to start, but could be soon
.

In January 2010 Cuadrilla applied to West Sussex County Council for planning permission to drill a exploration well, on a site where Conoco previously drilled a well in 1986, without success. Very few people were aware of this application and those that were assumed that it would be a similar story to Conoco, decades earlier. No one had heard of Cuadrilla or fracking and a mention of “stimulation” in the planning application did not mean anything to anyone. There were no objections and three months later permission was granted without any fuss.

The world has changed since the mid-1980s though and whereas Conoco were looking for conventional oil, in a reservoir of permeable rock, Cuadrilla – spurred by sky high energy prices – are prepared to go to much greater lengths to get hydrocarbons out of the ground. Unconventional oil and gas targets much less permeable rocks, with densely packed (usually) horizontal wells and various extreme stimulation techniques, such as hydraulic fracturing. While in Lancashire Cuadrilla are focused on getting gas out of the Bowland Shale, in Sussex they are after so called tight (shale) oil, similar to the Bakken Shale in North Dakota.

If this exploration leads to full scale development at the well-spacing now common in the Bakken, 4 wells per square mile, it could mean 32 wells within the parish of Balcombe and over 300 within 5 miles of the village. Up to 1,200 wells might be drilled in the the whole of Cuadrilla’s licence area. Further west, in the centre of the Weald valley where the formations are deeper, it is possible that gas rather than oil may predominate. Celtique Energie, who have licences across much of West Sussex, are bragging about quantities of gas that would require thousands of wells to extract.

These developments threaten to industrialise the Sussex countryside with well pads, and associated pipelines, compressor stations and processing plants. One only has to look to the US, Canada or Australia what living in the middle of such an oil/gasfield is like. Over 100,000 unconventional wells have been drilled in the US in the last decade, and thousands in Canada and Australia. In parts of the US, drilling is starting to push into the outskirts of cities, as they run out of countryside to frack. See this article Fracking Sussex: The Threat Of Shale Oil & Gas for more details.

P1030733 P1030724 P1030703

It was only following the publicity around Cuadrilla’s misfortunes in Lancashire (breaking their first test well with an earthquake they caused) that Balcombe residents became aware of what was planned, and a public meeting was called in the village hall in January 2012. Cuadrilla managed to invite themselves to the meeting and came in will their PR team to smooth things over. After they had been grilled for several hours by hundreds of angry locals, they retreated to lick their wounds. However with their temporary planning permission due to expire in September this year, they are now keen to proceed as soon as possible.

Recently Cuadrilla returned to Balcombe and held a “consultation”, to explain their plans. Wary of their previously reception they booked a small hall for the afternoon that could only hold a few people at a time, and packed it with executives. The village responded, coating the area in anti-fracking signs, organising a kids anti-fracking picnic and mounting a continuous protest outside the venue. As usual Cuadrilla were less than convincing, with a Cuadrilla executive even caught on tape admitting that everything they said sounded like “utter fucking bullshit”.

Meanwhile security guards, from the third worst company in the world G4S, have been present at the site 24 hours a day for several weeks. Last week a small drilling rig arrived on site to drill a water monitoring well, in preparation for the main event. In response the locals begain organising a Rigwatch outside the site entrance, to keep track of what Cuadrilla are up to. On Monday a tea party was held outside to site, to protest Cuadrilla’s presence.

Cuadrilla have still not cleared all the hurdles they need to in order to commence drilling, however. They require mining waste and radioactive substances permits in order to dispose of the toxic and radioactive waste the drilling will generate. In Lancashire the Environment Agency waved the requirement for a permit allowing Cuadrilla to dump radioactive sludge from their Preece Hall site into the Manchester Ship Canal, but there is no information about any plans for where this waste would go. The Environment Agency have launched a month long consultation on the permits, potentially delaying drilling into July.

Regardless of these legal issues, Cuadrilla are faced with having to try to push through the drilling despite the near unanimous opposition of the local community. Across Sussex people are equally unkeen on the threatened industrialisation of the county. In Australia, where three gas companies have already been forced out of New South Wales, community opposition has been highly effective. The industry is suggesting blackmailing communities with the threat of withholding public services, or bribing them with cash payments, to acquiesce to the destruction of their environments. They are clearly worried by the mounting opposition.

CAMPAIGNERS BUILD DUAL CARRIAGEWAY ON OSBORNE’S DOORSTEP IN SPENDING REVIEW PROTEST
Money for new roads bad for jobs, countryside and climate say campaigners

12 noon, Sunday 23 June: Anti-road campaigners have built a 50m long dual carriageway next to Chancellor George Osborne’s country retreat this morning, in a protest against the expected funding for new roads in this Wednesday’s (26 June) 2013 Spending Review [2].

Twenty people rolled-out the 8m x 50m road in the grounds of Crag Hall in the Peak District National Park this morning and used giant eight-foot letters to spell out the words “NO NEW ROADS”. Photos are available from photojournalist Adrian Arbib [3].

Osborne moved into “a two-storey building near Crag Hall, a sprawling £4million country estate which is owned by his long-term family friend Lord Derby” earlier this year; “lunches most Sundays” at the nearby Crag Inn pub; and has been a guest at falconry events at the Hall [4]. Reportedly, he “often talks about how brilliant it is to come to the country and enjoy some peace and quiet” [4].

The campaigners – who include an artist, a teacher, a physicist and at least four grandmothers – travelled from Hastings, where peaceful protests against the £100m Bexhill-Hastings Link Road (BHLR) have already led to 30 arrests and attracted national media attention [5]. The BHLR is the ‘first and the worst’ of over 200 new road-building projects that the Chancellor, Big Business and local councils are currently pushing throughout England and Wales [6]. Mr Osborne is believed to have pressured the Department for Transport (DfT) into funding the BHLR as a test case for Britain’s largest road-building programme in 25 years.

Karl Horton, a spokesperson for the Combe Haven Defenders, one of the groups involved in today’s action, said: “George Osborne is building a pointless and destructive road to nowhere on our doorstep – and is planning to build scores more on other people’s – so today we’ve come and built one on his. His obsession with building new roads is bad for jobs, bad for our countryside and bad for our warming climate. It can – and will – be met with sustained peaceful resistance.”

A “National Rally Against Road Building”, backed by Greenpeace, Friends of the Earth and the RSPB, will be taking place in Crowhurst, on the route of the BHLR, on Saturday 13 July [7].

“NFU Mutual is the commercial arm of the National Farmers Union (NFU). They provide a huge part of the income for the NFU and enable it to be a lobbying powerhouse in UK politics. The funding they provide to the NFU is used to ensure that animal welfare regulations on farmers remain lax; that farmers continue to receive huge subsidies; that the horrific live export trade can continue and also ensure that they are able to get the government to allow them to persecute wildlife such as badgers in complete disregard to the law which has them as a protected species. The NFU and NFU Mutual are so closely linked that NFU reps are also sales agents for NFU Mutual. NFU Mutual makes the profit that greases the wheels of political lobbying to allow the slaughter of our innocent wildlife. Last September we decided to come out of our sett and get hacking NFU Mutual, our biggest target.

Since the beginning of May we have exploited vulnerabilities on NFU Mutual systems to allow us to download almost all of their customer files including full financial details, claims and account history. Our access is so complete that we were able to make subtle modifications to the accounts of several people we know are involved in the badger cull.

As more people are identified as being part of the badger cull we will exploit the details we have on them. We will show the same mercy to their finances that they show to the lives of badgers. We already have plans to use the details we have on some of the more high profile supporters of the cull.

This is Bodger and Badger. NFU Mutual bodged their security and so we are now badgering them.

Badgers have friends, and those friends are hackers.

Brighton squat trial — longer update

Flyer27.05.2013

Flyer27.05.2013

One squatter convicted, two walk free. An appeal for the one has already been launched…

We are pretty shocked to report that the third and last defendant was found GUILTY under s144 on May 24. He was sentenced to 40 hours unpaid labour and a £250 fine. Previous updates can be found on the rooftopresistance website. This decision was immediately appealed and we will let you know the next court date asap.

The magistrates said in their “judgement” that:

The defendant was a trespasser
The defendant was living there
The building was residential

In support of their claim that the defendant lived there, the magistrates said there was shower gel in the shower, pots and pans in the kitchen and a light on in the fridge. This is clearly far from a legal definition of living, especially since the defendant was not actually linked to any of the items in any way.

In support of their claim that the building was residential, the magistrates appeared to rely on the tried and trusted adage that ‘the police said it was true so it must be true.’ They ignored evidence obtained from the Council that the building had never been converted to residential.

What does this mean? We think this means that a judge (or indeed anyone with legal training) will quickly overturn this decision. Mike Weatherly says he is delighted that our friend is convicted. We will be interested to hear his reaction when our friend returns to having no convictions again in about six weeks.

The other two defendants had previously had their cases dropped on grounds of no case to answer (no comment from Weatherly about that). The only difference with the case for the third defendant was that a cop claimed the defendant had said to him that he lived in the building. This evidence was used in court despite not being taken under caution (there are grounds for appeal on that alone!) and the magistrates took it as a voluntary confession, despite it being disputed by the defence.

In order to reach this decision, the magistrates appeared to prize the word of one policeman over another, since although one had claimed that the defendant had said he lived in the building, another said he had not.

In the eyes of these right-wing dipshits, it is fine for the police to act as property protectors, an approach which has already had tragic consequences.

All in all, this trial was a farce, with untrained magistrates being asked to implement an ill-thought out new law. They failed to do their job properly and the only good thing to come out of this conviction is that hopefully a decent legal precedent will be set on appeal which makes clear what ‘living’ and ‘residential’ mean in the eyes of the law. We do not doubt that this will lead to our friend’s conviction being overturned AND this new law becoming unworkable in practice.

PS Thanks to everyone for their continued support and props to the entire public gallery for walking out when the magistrates unveiled their prejudices.
